“At what point does a government employee’s right to free speech end and the government’s ability to control the communications of its employees begin? New laws have emerged in this area due to the increasing number of ways individuals have to express themselves electronically, through blogs, chat groups, and social media. This session will focus on an employee’s First Amendment rights to certain kinds of speech in and out of the workplace as well as the pitfalls government employees must avoid when disciplining and terminating others for expressing personal opinions. The panelists will also examine the role of qualified immunity as a defense for government employers who have fired or disciplined employees for engaging in free speech in their online activities and the potential for claims arising from such actions.”
